General Terms and Conditions

Introduction

Meyer – Strategies for a Digital World GmbH with the division Hike&Dine (hereinafter “Hike&Dine” or “We”) is a limited liability company registered in the Commercial Register of the Canton of Zurich with its registered office at Röschibachstrasse 63 in Zurich (company number: CHE-214.250.923). On the website https://hikeanddine.com/ (hereinafter “Website”) Hike&Dine operates an online shop (hereinafter “Shop”) in which selected goods in the field of hiking fashion are sold.

The following General Terms and Conditions (hereinafter “T&C”) define the contractual relationship between Hike&Dine and the customer (hereinafter “customer” or “you”) for purchases and orders made in the Shop.

General

The Hike&Dine store is only available to adults over the age of 18 with a delivery address in Switzerland, Liechtenstein, Germany, or Austria.

The version published at the time of purchase or order is valid. 

Order and conclusion of the contract

An order is only possible if the customer has accepted these terms and conditions. For an order, the e-mail address, first and last name, address, and date of birth of the customer are required. A customer account can but does not have to be created. Generally, you don’t have any right to claim an order.

By placing your order, completed by clicking the button “Send order”, and by accepting these terms and conditions, you make a legally binding offer to conclude a contract. The customer is required to check the order and shipping address for typos and/or incorrect details before clicking on “Send order”. Changes to the order after the conclusion of the contract or confirmed orders are only possible by contacting our customer service via mail to [email protected].

Orders via the shop will be confirmed to the customer by e-mail. A contract between the customer and Hike&Dine is only concluded after the reception of this confirmation. Hike&Dine is free not to accept orders. The conclusion of the contract is subject to the availability of the ordered items.

Withdrawal from the contract

If a contract of sale has been concluded, but the ordered goods are not available from our suppliers in the foreseeable future, Hike&Dine reserves the right to withdraw from the contract of sale without giving any reason. In case of withdrawal from the contract due to unavailability of goods, Hike&Dine will inform the customer immediately and refund already made payments without delay. By accepting the GTC, the customer expressly waives the right to assert any further claims against Hike&Dine resulting from the withdrawal from the contract, in particular the right to claim damages and/or interest.

Delivery and shipping

The dispatch takes place exclusively with the provider Swiss Post. Benefits and risks are transferred to the customer as soon as we have handed over the goods for shipment. The ordered goods are not insured against transport damage. We ship with the following flat shipping rates: 

Switzerland: CHF 9.- 

Liechtenstein: CHF 9.- 

Germany: CHF 25

Austria: CHF 25

If the customer does not accept the ordered goods on the delivery date, Hike&Dine can cancel the purchase contract and charge the customer for the delivery costs incurred and a handling fee of 20% of the order value, but at least CHF 60, as well as any loss in value of the ordered goods.

The customer must inform Hike&Dine of any change of address before placing the order. If the customer lack providing this information to Hike&Dine, the last known address will be used for all deliveries.

The delivery of the ordered goods, including custom-made products, will take place within 2-14 working days. Should the delivery time be extended due to circumstances beyond Hike&Dine’s control – e.g. because the supplier does not fulfill his contractual obligations towards us or does not do so in time – the customer will be informed immediately. Hike&Dine expressly reserves the right to withdraw from the contract. All information about availability and delivery time is therefore without guarantee and can change at any time.

Inspection of the goods and notification of defects

The customer is obliged to check the goods immediately after receipt for completeness and intactness. If the customer finds any damage, it must be certified by the shipping provider Swiss Post if possible and Hike&Dine must be informed immediately. Defects discovered at a later date must be reported to Hike&Dine immediately upon discovery.

Incorrect and incomplete deliveries or defective deliveries can be returned within the framework of the right of withdrawal (see clause 9 of these T&C).

Goods illustration and offer

Images of goods on the website may differ slightly from the actual appearance of the delivered goods. Possible errors, misprints, technical or color deviations between the depicted goods and the goods delivered to you Hike&Dine reserves despite the greatest possible care. In addition, Hike&Dine assumes no liability for the accuracy of the manufacturer’s information on the goods. All offers of goods listed in the shop of Hike&Dine are non-binding.

Liability

The liability of Hike&Dine is governed by the applicable legal provisions. However, Hike&Dine is in no case liable for slight and medium negligence, indirect and consequential damages and lost profits, unrealized savings, as well as damages from delay in delivery, whether contractual or non-contractual.

Normal wear and tear of ordered goods do not constitute damage or defect.

Hike&Dine is not liable for defects that the customer recognized or could have recognized upon receipt of the goods and did not report to Hike&Dine immediately after discovery and within the warranty period.

Hike&Dine assumes no liability for erroneous or missing information.

Right of withdrawal, complaints, and returns

In case of defects or dissatisfaction with the goods purchased, Hike&Dine grants customers a right of withdrawal within 14 days after receipt of the ordered goods. 

Special orders such as customized goods do not fall under this right of withdrawal. Instead, we grant you a right of rectification within 30 days after receipt of the ordered customized goods. 

To exercise the right of withdrawal or the right of rectification, we ask the customer to notify us at the following e-mail address: [email protected]

Only goods notified within the time limit will be refunded or repaired after inspection. The return in original packaging within 14 days after receipt of the ordered goods at the latest (“return period”) is to be sent to the address communicated in the mail.

The time of arrival of the ordered goods is decisive for the observance of the return period. The exercise of the right of withdrawal does not require any justification. The costs for the return are to be covered by customers.

We will refund the purchase price paid within 14 days after we have received back the goods. The goods have to be undamaged, unworn/not used, and in original packaging. Credits of the purchase price will be transferred back to the customer on the payment method used for payment. 

Hike&Dine has the right to refuse the refund until we have received the goods back. We reserve our right to deduct damaged goods and goods with signs of excessive wear from the refund.

Prices and payment methods

All prices shown in the shop are priced in Swiss Francs and include the legal value-added tax (“purchase price”). The costs for packaging and shipping are shown separately by Hike&Dine before the order is sent (flat rate shipping costs). These are to be borne by the customer and will be added to the purchase price.

Hike&Dine reserves the right to change prices and assortment at any time. However, the prices valid on the order date and indicated on the email confirmation will always apply to the goods ordered by you.

Hike&Dine points out that all orders outside of Switzerland may incur customs duties and taxes, which are to be borne by the customer. Hike&Dine is not responsible for any costs or duties incurred by shipping abroad. 

Only one promo code can be used per order. Promo codes are not cumulative. 

We accept the following payment methods: payment by credit card and Google Pay.

Final provisions and place of jurisdiction

Swiss law is exclusively applicable, excluding its conflict of laws rules. The place of jurisdiction is Zurich, Switzerland.

In many cases, we can offer better assistance and product information because of our relationship with our partners. Of course, we only work with partners we trust. We do not exclusively work with one partner; we want to be independent and link to the websites that serve our visitors best while earning sufficient income to keep this website running.
